§ 3 – Scope

  1. These General Terms and Conditions apply to all offers made by the trader and to all orders and distance contracts between the trader and the consumer.
  2. The text of these General Terms and Conditions is made available to the consumer on the website before the contract is concluded and can be accessed, saved and printed there at any time.
  3. Should individual provisions of these General Terms and Conditions be or become wholly or partly invalid, the validity of the remaining provisions shall not be affected.

§ 4 – The offer

  1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
  2. If an offer is limited in time or subject to conditions, this will be expressly stated in the offer.
  3. The offer contains a complete and accurate description of the products offered. The product images represent the products truthfully. However, slight colour deviations due to screen settings are possible.
  4. Obvious mistakes or typing errors in the offer are not binding on the trader.

§ 5 – Conclusion of the contract

  1. By submitting the order, the consumer makes a binding offer to purchase the products in the shopping cart.
  2. The trader confirms receipt of the order without delay by email. The contract is concluded with this confirmation.
  3. Before submitting the order, the consumer can check and correct their entries at any time.
  4. The language of the contract is English.
  5. The trader takes appropriate technical and organisational measures to secure the electronic transfer of data and the processing of payments.

§ 6 – Right of withdrawal

  1. Consumers have a statutory right of withdrawal of 14 days. Details can be found in our cancellation policy.
  2. In addition to the statutory right of withdrawal, the trader voluntarily grants the consumer a right of return of 30 days in total from receipt of the goods. The conditions for this are set out in our Returns & Exchange Policy. The statutory right of withdrawal remains unaffected.
  3. The consumer may inspect and try on the goods as would be possible in a physical shop. The consumer is liable for any loss in value resulting from handling the goods beyond this.

§ 7 – Costs in the event of withdrawal

  1. If the consumer exercises their right of withdrawal, they bear the direct costs of returning the goods, except for defective or incorrectly delivered products.
  2. The trader will refund all payments made by the consumer, including the original delivery costs, without delay and at the latest within 14 days of receiving the notice of withdrawal. The trader may withhold the refund until the goods have been received back or the consumer has provided proof that the goods have been sent back.
  3. For the refund, the trader uses the same means of payment that the consumer used for the original transaction.

§ 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

  1. goods made to the customer's specifications or clearly tailored to the consumer's personal needs;
  2. sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

§ 9 – Prices

  1. All prices shown are final prices and include statutory VAT.
  2. Shipping is free. The consumer will not incur any additional customs or import charges.
  3. The price shown at the time of ordering applies.

§ 10 – Payment

  1. Payment is made when ordering using the payment methods offered at checkout (credit or debit card).
  2. The consumer is obliged to report any inaccuracies in the payment details provided to the trader without delay.

§ 11 – Delivery

  1. The trader carries out orders with the greatest possible care.
  2. The place of delivery is the address provided by the consumer when ordering.
  3. Delivery times are stated on the shipping page.
  4. If delivery of an ordered product is not possible, the trader will inform the consumer without delay and refund any payments already made within 14 days at the latest.
  5. The trader bears the risk of damage to or loss of the goods until they are handed over to the consumer.

§ 12 – Warranty

  1. The statutory warranty rights apply. The warranty period is two years from delivery of the goods.
  2. The trader guarantees that the products conform to the contract and have the characteristics stated in the offer.
  3. The consumer is asked to report obvious defects or incorrectly delivered products as soon as possible to info@trymenshape.com. The statutory warranty rights remain unaffected.
  4. Defects resulting from improper handling, failure to follow the care instructions or normal wear and tear are not covered by the warranty.

§ 13 – Complaints

  1. Complaints can be sent at any time by email to info@trymenshape.com.
  2. The trader responds to complaints within 14 days of receipt. If handling the complaint takes longer, the consumer will receive an acknowledgement within this period, stating when they can expect a detailed response.

§ 14 – Applicable law
